You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using the Services and may only use the Services for lawful purposes (e.g., not for the transportation of illegal or hazardous materials). In some cases, you may be required to provide an identification document or other identity verification element for access or use of the Services, and you agree that access or use of the Services may be denied if you refuse to provide the identification document or identity verification element.

Text Messages

By creating an Account, you agree that the Services may send you informational text messages (SMS) as part of the normal business activity related to your use of the Services. You may request to no longer receive informational text messages (SMS) from Cargo Produce Inc. at any time by visiting cargoproduce.com/contact and indicating that you no longer wish to receive such messages, along with the mobile device phone number receiving the messages. You acknowledge that requesting to no longer receive informational text messages (SMS) may affect your use of the Services.

Access to Network and Devices

You are responsible for obtaining the necessary data network access to use the Services. Data and messaging rates from your mobile network may apply if you access or use the Services from a wireless device, and you are responsible for these fees. You are responsible for acquiring and updating the compatible hardware or devices necessary to access and use the Services and Applications and any updates thereto. Cargo Produce Inc. does not guarantee that the Services, or any portion thereof, will function on any particular hardware or device. Additionally, the Services may be subject to malfunctions or delays inherent in the use of the internet and electronic communications.

Limitation of Liability

Cargo Produce Inc. shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to loss of profits, data loss, personal injury, or property damage, nor for damages relating to, or in connection with, or otherwise arising from any use of the services, even if Cargo Produce Inc. has been advised of the possibility of such damages. Cargo Produce Inc. shall not be liable for any damage, liability, or loss arising from: (I) Your use or reliance on the services or your inability to access or use the services; or (ii) Any transaction or relationship between you and any third-party provider, even if Cargo Produce Inc. has been advised of the possibility of such damages. Cargo Produce Inc. shall not be liable for delay or non-performance resulting from causes beyond the reasonable control of Cargo Produce Inc. You acknowledge that third-party transport providers offering transportation services through certain order brands may offer shared or peer-to-peer car services and may not have the required license or professional permission.

In no event shall Cargo Produce Inc.’s total liability to you in connection with the services for all damages, losses, and judgments exceed one hundred euros (€100) or the equivalent in the national currency.

You may use Cargo Produce Inc.’s services to request and plan transportation, goods, or logistics services with third-party providers, but you agree that Cargo Produce Inc. has no liability to you in connection with any transportation, goods, or logistics services provided to you by third-party providers except as expressly stated in these terms.

No Business or Professional Relationship

Your use of the services provided by Cargo Produce Inc. does not establish any business or professional relationship between you and Cargo Produce Inc. You acknowledge and agree that you are not an employee, agent, partner, or joint venture of Cargo Produce Inc., and that you do not have any authority to represent or act on behalf of Cargo Produce Inc. You further understand and agree that no independent contractor, agency, partnership, or joint venture relationship is formed by your use of the services.

Jurisdiction and Applicable Law

These Terms and Conditions shall be governed in all respects by the laws of the State of Texas, United States.

Any dispute arising from these Terms and Conditions, their existence, validity, interpretation, scope, or compliance shall be submitted to the jurisdiction of the ordinary Courts and Tribunals of Austin, Texas, United States.
